Abstract

     ‘Adl, according to Islamic literature, is a moral principle which regulates social, political and legal aspects of human activities. Several ahadith of the Prophet prove strong bond between justice (‘adl) and faith (īman). Some ahadith even negate īman without following morality. The purpose of Allah’s sending messengers is to develop human thought and conduct to a highly mannerful behavior. The last Messenger was sent to perfect noble manners of people because ‘adl, in a true sense can be realized only by a society strictly adhering to moral principles and mannerism. Both īman and sense of morality create strong force for action and motivate to establishing justice and rule of law.

     The paper explores the principle of ‘adl in the light of Prophet’s judgments and instruction given on the basis of moral principles.

The paper also examines aspects of ‘adl implied in the maqasid al-Shariah discussed by the jurists and al-hawa‘ij al-asliyyah (الحوائج الأصلیہ) argued by the fuqaha. Some relevant legal maxims have also been discussed which are helpful for members of judiciary, jurists, muftis and arbitrators who collectively promote and protect social justice in human societies.
