Abstract

The general mood of society about recognizing and empowering women's rights has always been disappointing. If the problem is seen in the context of Khyber Pakhtunkhwa, the situation becomes even more troubling, One of the reasons is that the society here is influenced by the ancient tribal system. It is clear that the fatwa’s of the Khyber Pakhtunkhwa have a large influence on the jurisprudence of the jurists here. So the question is, what do the jurists here think about empowering women and recognizing their rights? It is also a question whether the jurists have raised their voices against this notion? An important question is: If the jurists have raised their voices, what changes have they made to the general mood of society? It is also important that the jurists are not compelled by the traditions, habits and customs of women here.

Here are brief answers to these questions: The woman is empowered about her personal possessions, So he does not need permission from anyone to meet his religious, social, charitable and personal needs. The Haqqa Mahar and dowry is pure property by a woman, Therefore, it is not permissible to occupy it by the father or the husband. A woman can do everything she can to protect her rights, And her attempt will not be considered disobedience to father or husband. It is not shameful for a woman to marry on her own, or to refuse to marry at will, and nor is it against the honor, So that she can be killed in honor.
