Qawaid e Fiqhiyyah and its importance in the modern times

(A conceptual study)

Abstract

The knowledge of  Usul Al-Fiqh,  Al-Qawaid Al-Fiqhiyyah and Al-Dawabit Al- Fiqhiyyah holds great importance in  Shariah (Islamic Law). The stronger the reach of these two, the more mature will be the understanding of  Shariah.

In the beginning, this knowledge went hand in hand with Jurisprudence, but then for a long time this knowledge remained neglected and was replaced by the philosophy of Jurisprudence. But in modern times, this knowledge has regained its attention and permanent books and even encyclopaedias have been written on it. At the same time, it is a part of the curriculum at university levels. But the biggest confusion is: What is the difference among these there terms: Al-Qawiad Al- Usuliyyah, Al-Qawaid Al-Fiqhiyyah and Al-Dawabit Al- Fiqhiyyah?

If the knowledge of Al-Qawaid Al-Fiqhiyyah and  Al-Dawabit Al- Fiqhiyyah is related with Fiqh  (Islamic Law) then there is a need to induce and compile the most important Qawaid and Dawabit of different fields of fiqh so that a student can easily introduce all the fields of Fiqh on a solid basis in the form of leading Ahka and then come forward and try his academic fortune in any field of Fiqh.

This study will discuss the correct concept of Al-Qawaid Al-Fiqhiyyah and Al-Dawabit Al- Fiqhiyyah, its usefulness, its validity, its original place in Islamic Law and its effective methodology in modern times.
