Abstract

 

Islam is a universal and all-encompassing religion that possesses the ability to guide humanity in every era and under all circumstances. The life of the Prophet Muhammad ﷺ was also made to pass through various testing phases so that his noble example would be available to the Ummah in every kind of situation. The Makkan period provides guidance for those Muslims who live as minorities in non-Muslim majorities, while the early Madinan period and the migration to Abyssinia serve as models for Muslims living peacefully among non-Muslims under agreements of mutual coexistence and religious freedom. Today, more than half of the world's Muslim population resides in countries where non-Muslims are the majority, and they face numerous new challenges — prominently including issues related to halal and haram, family life, economics, and politics.

To address such challenges, scholars and jurists have introduced a new branch of jurisprudence known as Fiqh al-Aqalliyat (Jurisprudence of Muslim Minorities), which provides Islamic guidance based on the specific conditions and needs of Muslims living as minorities. In various parts of the world — such as India, Europe, America, China, and Canada — Muslims have settled for employment, education, and other necessities of life. These minority communities encounter unique societal and legal challenges, which necessitate specialized Islamic rulings. Therefore, Fiqh al-Aqalliyat has become a highly important field in contemporary times, and the present paper focuses on analyzing these pressing issues.
