Abstract

A clean environment is a basic necessity for every era and human life. In the early days of Islam, when environmental pollution was not as significant a threat, Islamic teachings addressed this issue more from an ethical standpoint than a legal one. Islam provides a foundational framework, allowing for detailed rulings to be developed according to the needs of each era. The article is divided into three parts. The first part reviews the evolution of international environmental law, highlighting how environmental protection has become increasingly critical over time and how international legislation has sought to address this need. The second part discusses the importance of environmental protection in the Quran and Sunnah, citing specific texts. The third part explores several jurisprudential rules and principles related to environmental utilization and ensuring that such use does not harm others' rights. This work examines Islamic law principles related to environmental protection, particularly in the context of modern challenges such as climate change and warfare. It analyses relevant texts from the Quran and Sunnah through the lens of jurisprudential rules and principles, exploring how Islamic law addresses environmental protection and its implications for contemporary issues. The study highlights the evolution of international environmental law. It outlines key principles from existing agreements, while also discussing the importance of environmental protection in Islamic teachings and its application in situations of armed conflict. The findings aim to provide insights into the relevance and applicability of Islamic law in addressing environmental challenges in the modern era.
