Abstract

The system that Allah Almighty has created regarding the different stages in the birth of a human being and in the womb of the mother amazes the human intellect and attracts the contemplation of human creation, as well as challenging the non-Muslims that there is such a hidden power that can create a human being with such precision and in the best way.

Undoubtedly, in the Qur'an and Hadith, various stages related to the fetus in the mother's womb have been mentioned in great detail, in which there is also a description that after the entire body is formed in the mother's womb, the child's age, sustenance, death, misfortune, or good fortune and destiny would be written, and then the last step comes to start the signs of life, i.e., putting the soul.

Regarding the stages of change in the mother's womb and the beginning of signs of life, two types of understanding have been taken from the traditions that have come. According to one understanding, these stages are completed in four months, and then the signs of life begin. This understanding belongs to ancient jurists and doctors, while according to another understanding, these stages are completed in forty to forty-five days, and then the signs of life begin. This understanding is supported by some modern jurists and belongs to doctors.

Ancient jurists and doctors based on the Sahih Bukhari tradition of Hazrat Abdullah Bin Masoud RA have given this fatwa that the various stages in the womb are completed in four (4) months and then the signs of life begin, while according to some modern jurists and medical scientists, these stages are completed in forty to forty-five days and then the signs of life begin.

Due to this difference, the importance of this topic increases a lot because the orders of sanctity of abortion, disgust, or obscenity are based on it, and it will be discussed in detail in this article.
