In every age and era of human history, war has been imposed on human beings. And the most affected group of people, in these wars, were the prisoners of war, who have been treated ferociously the most. Even in the present time the most affected of war is the prisoners of war who are treated inhumanely. In view of this, I thought of writing about the prisoners of war. Imam Surakhsi, one of the great Imams of the Hanafis, in his book Sharh al-Seer al-Kabeer, has made many statements about the prisoners of war which are very similar to the agreements of the present-day. In view of this, the following article presents a researching and comparative analysis between them. This research focuses on the point that the ideas about prisoners of war presented by Imam Surakhsi are similar that are present in the Geneva Conventions. Imam Surakhsi's statements emerge as important source in proving the supremacy of Islamic law. The following issues will be kept highlighted during the research. Imam Surakhsi’s remarks, compared to Geneva Conventions, is presented as a comparative study, mentioning both, agreed and contradictory clauses prisoner of war, civilized, crimes, Geneva Conventions, community, modern, humanity.
