Abstract

In Pre – Islamic era, humanity, with all its peoples and nations, lived in the worst conditions, as naturally, it loses the correct order that refines its behavior, and both individuals and groups, maintain its dignity and preserve its rights and these qualities are the greatness of our true religion.
God Glory be to Him, has honored this nation with the Sharia of Islam, which is the eternal Sharia that cannot be abrogated, comprehensive and untainted by defects. Its provisions have absorbed all the aspects of life and its affairs, it has build up the relationship between people and prevented them from sufferings, and legislated that guarantee people a decent life.
One of the most important distinguishing features of Islamic legislation is to preserve the human happiness.
The most important thing that wise people demand in their systems to which they are subject is that they achieve the maximum possible guarantees sufficient to preserve their religion, themselves, minds, honor and money, the guarantees which have not been achieved for them are the theoretical and practical fields.
The Islamic Sharia contained sufficient legislation to preserve the necessities of human life: (religion, the soul, the mind and money). priorities of Islam is in preserving the human soul, as divine wisdom required that its existence in a universe is as an architecture that is devoted to service of mankind.
